With the advancement of artificial intelligence (IA), many ethical issues have come to light, including the production and dissemination of nude images or sexual content without people’s consent.
The abilities of AI systems have made this type of action possible and have motivated important debates within the legislature in several countries. In Brazil, the onslaught began to be implemented.
On December 7th, federal deputies approved a measure that aims to protect individual privacy.
The text basically criminalizes the use of artificial intelligence to create nude scenes without the release or authorization of the person present in the illustrations.

If approved in a final vote and sanctioned, the proposal would make this type of act a crime, with a penalty of one to four years in prison, in addition to a fine. After approval of the Chamber of Deputiesthe bill (PL) now goes to the Senate.
In the justification of the measure, it is mentioned that this practice violates people’s privacy, in addition to intimidating and causing emotional and psychological harm.
The proposal is authored by federal deputy Erika Kokay (PT-DF) with rapporteur by deputy Luísa Canziani (PSD-PR). The text points out that the creation of montages with sexual content insults the dignity and self-esteem of victims.
Aggravating aspect
The measure also provides for possible aggravating factors for the application of the penalty, such as the commission of a crime aimed at professional, commercial or functional activity.
In this type of situation, the penalty may be increased by 50%, given the additional severity when the invasion of privacy occurs in a deliberate and organized manner.
Changes in the law
In addition to criminalizing this type of attitude, the project also proposes changes to the Brazilian Penal Code.
The PL suggests increasing punishment for anyone who produces, photographs, films or disseminates sexual intimidation content without authorization. Today, the law stipulates a penalty of six months to one year in prison for such behavior.
The idea, now, is to increase the penalty and severity of the crime, in the eyes of Justice, in order to create a more detailed and robust law.
The same text also stipulates specific penalties for those who publicize scenes of rape of a vulnerable person and simulate the participation of children in sexual acts. The expected punishments are two to six years in prison plus a fine.
