Last Tuesday (27), the Senate Education Committee took a crucial step by approving the Legal Framework for Electronic Gamesregulatory law that aims to bring clarity and boost the development of the games industry in Brazil.

The approved text introduces a series of changes and advances, ranging from the definition of electronic games to crucial tax benefits for the sector.

Strengthening the games industry in Brazil

The main objective of the framework is to avoid confusion and establish clear parameters for the electronic games.

Thus, the text will promote, at the same time, the strengthening of the film industry and the development of new technologies applied to various areas, such as basic industries, consumer goods and health.

Among the changes promoted by the Senate, the removal of ‘fantasy games’ from regulation stands out, as such models were previously regulated alongside sports betting.

Furthermore, a significant change is the permission to use games as educational and therapeutic tools for children and adolescents, recognizing the positive potential of the interactive medium.

The text will now go to the Senate plenary for a vote, before returning to the Chamber of Deputies.

During the review by the Education Commission, modifications were made to meet the demands of the sector and the Ministry of Finance, with an emphasis on key points to boost the electronic games industry in the country.

A notable highlight is the possibility of raising funds from cultural incentive programs, such as the Audiovisual Law and the Rouanet Law, by studios game development.

This measure is considered fundamental, especially for small developers, who often face financial challenges when executing their own projects.

Furthermore, the text positions the production of games as technological research and development of technological innovation, making companies in the sector eligible for the tax benefits of the Lei do Bem.

Such legislation offers significant incentives, such as the reduction of up to 80% of the amount invested in game development in the calculation basis of Income Tax and Social Contribution on Net Profit.

Another victory for the industry is the simplification of the import process of ‘dev kits’, essential sets for game development, by the Brazilian government.

However, the proposal highlights the importance of observing the regulations of the Ministry of Science, Technology and Innovation in the area of ​​research and technological innovation.
